When placing an order through our website, you are deemed to have read, understood and agreed to these terms and conditions. If you are dissatisfied or do not understand any aspect of these terms, please contact us before placing an order by sending an email to hello@missimuah.com .

AGREEMENT

These conditions govern our relationship with you. Any changes to these conditions must be made in writing and signed by both parties. This way, we can avoid any problems about what missimuah.com (Plural Fashion Unipessoal Lda) and you are expected to do. You confirm that in agreeing to accept these conditions you have not relied on any representation except to the extent that such representation has expressly been made a part of these terms and conditions, and you agree that you will have no recourse in relation to any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this clause will limit or exclude our liability in respect of any fraudulent or negligent misrepresentation, whether or not such representation forms part of the terms and conditions.

REPRESENTATION AND COLOR

We make every effort to accurately display our collections, however, occasionally due to users' monitors, resolutions, and individual settings, items may appear different. Therefore, we cannot accept any responsibility for poor color representation and strongly advise customers to contact us directly before making a purchase if they have concerns.

PRICES

All prices shown on our website include VAT for Portugal. For shipping destinations outside of Portugal, we have partnered with FLOW who will provide detailed breakdown and information for the respective country at checkout. Delivery fees are also applied at checkout depending on the desired delivery method and destination country.

PAYMENT AND SECURITY

All online orders require payment in full at the time of ordering. This can be done through our automated checkout. Our secure payment partners are Stripe, Ifthenpay, Klarna and PayPal. All of our payment providers are responsible for capturing and storing your payment information on their secure servers. We accept the following payment cards:

PAYMENT AND SECURITY

For your extra protection, Visa uses 3D Secure (VbV) and MasterCard uses SecureCode. VbV and SecureCode require a personal password for additional security, which can be created if this is your first online purchase. More details can be found at www.visa.com or www.mastercard.com . We regret to inform you that we are unable to accept payments via Solo, Diners Club or JCB. We also cannot accept concession store cards or gift cards including New Look, Outfit and Beales etc. However, our website can process gift cards issued by independent Missmiuah stores.

CONFIRMATION

As soon as your order on the website is received, we will send you an order confirmation email, detailing the item you have chosen to purchase. We kindly ask that you take a moment to ensure your order is correct. If you find any errors, please email us immediately at hello@missimuah.com .

DELIVERY TIMES

Estimated delivery times are provided in our deliveries section. Please be aware that whilst we will do our best to meet the stated deadlines, they are estimates only and are not contractual.

DELIVERY

All orders from the website will be delivered to the address provided at the time of ordering online. If your delivery details change before dispatch, please email us at hello@missimuah.com . Please note that once an order has been dispatched, we cannot change the delivery address. All orders are shipped from Portugal, so some international orders may have to pay additional fees and taxes. The buyer is responsible for paying these fees, which are typically calculated for you during your shopping experience on our website.

DELIVERY TO A DIFFERENT ADDRESS

We are happy to arrange delivery of your order to an address other than your credit or debit card billing address, but if you have not purchased from us before, we may contact you before processing your order to check that your credit or debit card is not being used fraudulently.

MULTIPLE DELIVERIES

Where possible we will group your order and send everything together, however this will not always be possible and as such we reserve the right to dispatch items separately.

DELIVERY NOTIFICATION

When your order is ready to be shipped, we will notify you by email. Please ensure that someone will be available to receive your order at the address provided. Failed deliveries will be returned to a local depot and our delivery agents will leave a notice of attempted delivery. If you receive a notice of attempted delivery, please follow the instructions provided by our delivery agents.

FAILED DELIVERIES

Sometimes, due to unforeseen circumstances, orders are returned to us. In these cases, we reserve the right to charge a re-delivery fee.

INCORRECT OR DAMAGED ITEMS

In the unlikely event that your order is incorrect, please notify our customer service team within 48 hours of receipt by emailing hello@missimuah.com or by raising a customer service ticket in your online account using our contact form.

PURCHASES AT CONCESSIONS

If you purchased an item from one of our dealerships and believe it is defective, please contact the store where the item was purchased directly. If you don't know the location of the concession or its contact information, you can find it on your purchase receipt or credit card statement.

RETURN OF AN ITEM

To exercise your right to cancel, you must inform us within 14 days from the day you receive your order. You can cancel by sending an email to hello@missimuah.com or by raising a customer service ticket in your online account using our contact form. Please make sure you include details of your name, address, order number and details of the item(s) you wish to return.

When returning an item, you can choose our free returns service. However, you can arrange the return yourself, in which case we are not responsible for the costs of returning the item to us. You must ensure that the item(s) you are returning are sent back to us within 14 days of the date you confirm your wish to return the products. All returns must be received and signed for by us within 28 days of the original delivery date.

REFUNDS

Upon receipt of your return, all items will be inspected and a full refund, excluding shipping costs, will be processed. Refunds can take up to 14 days to complete. We cannot accept any liability arising from the terms of use of card issuers or third party payment providers.

Refunds may also be subject to the following deductions:

  • Traffic damage
  • Loss in transit
  • Goods returned after a reasonable period of time
  • Not returned in original condition

COMPLAINTS PROCEDURE

If you have any questions or problems regarding any purchase made on missimuah.com, please contact hello@missimuah.com . If, after following our internal complaints procedure, you still feel that we have not resolved your complaint to your satisfaction, then you can access the EU Online Dispute Resolution platform.

EVENTS OUTSIDE OUR CONTROL

We will have no liability to you for any failure to deliver goods you have ordered or for any delay in doing so or for any damage to or defect in goods delivered which is caused by any event or circumstance beyond our control.

YOUR RIGHT TO CANCEL

It is not possible to cancel or make changes to your order once it has been placed. If you would like to add more items to your order, the quickest and simplest way to do so is to place a separate order for those additional items. If you would like to change the delivery address details specified when placing your order, please contact our customer service team as soon as possible, you can do this by sending us an email at hello@missimuah.com or raising a customer service ticket from your online account. We will try to resolve this as quickly as possible. If your order has already been dispatched or delivered to you, you will need to follow our online returns policy in case you receive unwanted or unsuitable items.

OUR RIGHT TO CANCEL YOUR ORDER

Sometimes we are unable to complete customer orders. If we need to cancel your order, we will contact you by email. There will be no contract between you and utgang.eu until we confirm your order by email and have dispatched your order/items to you.

INTELLECTUAL PROPERTY

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content provided as part of our website will remain, at all times, the exclusive property of Plural Fashion Unipessoal Lda.

RIGHT OF USE

You acknowledge and agree that the material and content contained on the website are available for your personal use only. Any other use of the material and content on our website is strictly prohibited. You agree not to (and you agree not to help or facilitate any third party to) copy, reproduce, transmit, publish any materials or content from our website.

DATA PROTECTION AND PRIVACY

When you create an account and make a purchase on our website, you are automatically subscribed to our newsletters, which will be sent to you by email. You can opt out of receiving these newsletters at any time by unsubscribing or unchecking the general subscription box. We collect certain personal information from you (e.g. your name, email address, payment address). All this information is kept on secure servers. missimuah.com fully complies with all applicable data protection laws and consumer legislation and we treat all your personal information as completely confidential. CHECKOUT AS A GUEST

If you don't want to create a full account, we also provide a guest checkout option. For the purposes of completing your order, we will still need to collect some personal information from you (for example, your name, email address, payment and shipping address). The guest information provided will only be used for the purposes of completing your order, legal and GDPR compliance.

THIRD PARTY RIGHTS

A person who is not a party to this contract has no right under the Contracts (Rights of Third Parties) PT Act 1999 to enforce any term of this contract, but this does not affect any right or remedy of a third party which exists or is available apart from that Act .

INVALIDITY

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of these conditions will not be affected.

AFFILIATE SCHEMES AND CODES

From time to time, we may offer promotions or codes through our affiliate network. These promotions can only be redeemed online at missimuah.com and cannot be redeemed in-store or through our concessions. We reserve the right to change, update or end these promotions without prior notice.

SOCIAL MEDIA SWEEPSTAKES TERMS AND CONDITIONS

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT DOES NOT IMPROVE YOUR CHANCE OF WINNING. For the purposes of these Terms and Conditions, "the Company" refers to Missimuah whose Instagram handle is @missimuah. The 'Prize' refers to the item mentioned in the post caption. By participating in the Prize Draw, you agree to be bound by these Terms and Conditions. All entries must be received by the date mentioned in the post. One (1) winner will be selected at random by the Company on the date mentioned in the caption and the winner will be notified on or after that date.

ELIGIBILITY

This Draw is open to all natural persons who are at least 18 years of age at the time of entry. The Sweepstakes is subject to all applicable local laws and regulations and is void where prohibited by law.

During the Entry Period, visit Instagram [@missimuah ] or the Company's Facebook page [@missimuah] and follow the instructions in the Giveaway post. Each participant must enter the contest via Instagram and follow the Company's Instagram page [@missimuah ] , like the Giveaway post and comment under the Giveaway post which item is most attractive to them. This Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram.

LIMITATIONS ON PARTICIPATIONS

Third party participation or participation through any sweepstakes service is not permitted. The use of robotic input devices is strictly prohibited. Only one entry per person per competition will be accepted. Missimuah.com employees cannot participate in the draw.

PRIZES

One (1) prize will be awarded, consisting of the item mentioned in the comments section under the Sweepstakes post. The Prize is non-transferable and no substitution or cash equivalent is permitted. The Prize is awarded “as is” without any warranty or guarantee. In the event that the required size is not available, the winner will receive the equivalent amount of the prize in online store credit, for which the winner will need to create an account at www.missimuah.com .

PRIZE DRAW

The winner will be selected in a random drawing from among all eligible entries collected during the Entry Period. The draw will be conducted by the Company, whose decisions and interpretations in all matters relating to the draw and these Terms and Conditions are final and binding in all respects. The Company reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is ineligible or has violated a rule, obtained an unfair advantage in the Sweepstakes, or obtained winner status through any means fraudulent. If winner is found to be ineligible or not in compliance with the Sweepstakes rules, winner will be disqualified and an alternate winner will be awarded in a separate random drawing. The winner will be notified via direct message on Instagram. Company's failure to contact winner on Instagram within one week of selection may result in winner's disqualification and an alternate winner may be selected in a random drawing at Company's discretion. The prize will be mailed to the winner within fourteen (14) days after the winner has been notified, accepted the Prize and provided Utgång personnel with their valid shipping address. If the Prize is returned as undeliverable, the Prize will be forfeited and another winner will be drawn at random. GENERAL TERMS

By participating in this Prize Draw, you promise to comply with the Social Media Prize Draw Terms and Conditions and the Company's decisions, which will be final and binding in all respects. The Company reserves the right, in its sole discretion, to refuse, disqualify or withdraw any entry at any time. Name of Winner. The winner's social media username will be published in a story on the company's Instagram profiles and saved in a highlight after the winner has been selected. Winners' social media name will be available in the Sweepstakes highlight unless winners request in writing to remove it.
